HI,
My 6 yr H1B is expiring within 4 months, my company will be filing for the 7th yr extension. Will there be any problem if I send my inlaws for visitor visa now.
Can any one please advice.

I'm going to guess that the same folks in the Tea Party screaming about the deficit will somehow find this breaking news to be irrelevant. I was wondering how many people really got the opportunity to use the reinstated PPS service for I-140 petition? Has it been useful to the most of people who are stuck in the I-140 backlogs for more than year now or has it only helped a tiny segment of the folks who really needed it to maintain their status?
What is the purpose of USCIS reinstating this PPS if it only helps only very few people. I think its time, USCIS either process the pending applications soon or reinstate PPS for everyone. 1 year is a long time to wait for an I-140 approval when USCIS can re-allocate the staff at quick notice (like those folks who received EADs in two weeks during June 08) if they want to. Its high time USCIS address this issue and get us out of this mess. Visa numbers does not have to be available to process I-140..so there is no reason for them to delay or give excuses.

I have my I140 approved under EB3 with the PD Aug'2003 with the employer A. Now I am planning to switch to employer B for filing Labor under EB2 category.
My question is Can I avail the PD i.e Aug'2003 got from the previous labor EB3 (i.s employer A) for the new EB2 labor with employer B.
My Exp: B.E + 8 Yrs of Progressive Exp.
Employer A:
labor : EB3 Approved PD AUG'2003
I140: Approved
Employer B:
labor: EB2 under process.
I would appreciate your reply, any attorneys pls.

My 140 was filed for a future Team lead position. I am currently a Sr Sw Engg with the same employer. The job description is nearly the same. But I am not sure how this little quirk effects my AC21 eligibility. When does my 180 day start counting ? From filing date or from the date I get the Team lead title ?

I am working on OPT and my spouse is filing AOS/EAD/AP. What happens till it is approved? Can I work?
yes, you can work on OPT till EAD comes. Once EAD comes, just file a new I-9 with EAD and continue working.
Remember, in OPT, you do not have to pay social security tax. Once you switch to EAD, you have to pay social security tax.

Today after more than a year of calling I was forwarded from NSC to Los Angles office. Looks like NSC CS is offline.
I used to call and narrate my case issues and they would say they emailed or asked me to callback. And my calls went nowhere. Today it got routed to LA office and they listened to my issue and said they are escalating the call and then I got to an officer. He took my case issue and gave me a service request no. NO ONE in Nebraska told me there was something called service request. (though I read about it recently in this forum). I had asked numerous times to the NSC CS how can I track my calls and they said you couldnt.
I think NSC CS should be sued for giving wrong info

I came to US on a L1 Visa, changed jobs got a H1 visa but never left the country for the last 3 years so dont have a H1 stamping in my passport.
I will be getting my 7th year extension (probably 3 yrs based on my approved I-140) soon and i have to visit India atleast this year. With no hopes of 485 filing and absolutely no hopes for CIR i need to plan to get a Visa stamping in my passport.
With the Interview dates at US Embassy in Chennai already gone till December First week, do you know whether i can get my H1 stamping done in any of the Canadian Embassies?
Has anybody whose case is similar to mine got their stamping done in Canada? Advice me on any risks.

My wife was working for a company before. They had filed for her GC. She has an approved I140. She had to convert to H4 because of some legal reasons and could not continue to work for the company. Now she has a valid H4.
She has already been here 7 years on her old H1. Now can she file for a H4-H1 and get a 3 year visa based on an approved 140 ?
The lawyer says that the 3 year extension rule just states that H can be continued beyond 6 years based on approved 140 and so she can go back to a H1...
Anyone here has had a similiar experience ?

My kid brother (15 years old and US Citizen) lives in India with my parents. They are quite elderly now to take care of him and we were thinking of bringing him to US legally to live with us. We want to adopt him so that he can have a good lifestyle here and have no issues legally in future. Is there anyone who has gone through similar case before ? Also, I wanted to ask if there are any attorneys that specialize in cases like these ? If so please let me know and I would like to hold a consultation asap.
