Nobody can predict when the quota will fill up. However, note that there are wide spread rumors about the regular quota being used up as early as the first day and Masters within a few weeks. Its in your best interest to file as early as possible.

To retain the PD, you would need the copy of the I140. Without that, there isn't much that can be done when you switch companies to keep your PD.

B-1 visa is for the visitor who has an unabandoned foreign residence, intends to visit only temporarily and intends to engage only in permitted business activities.
B-1 business visitor may be admitted for the purpose of enaging in business but not for the purpose of local employment or labor for hire. in distinguishing, the determination would be whether the principal place of business and actual accrual of profits are in the foreign country. Permitted business activities may include
Engaging in commercial transaction which do not involve gainful employment
Negotiating contracts;
Consulting with business associates; and
Participating in scientific, educational, professional or business conventions, conferences
B visitors may apply for extension of stay in six month increments and may change to other non-immigrant visa statuses.

Hi,
Apologies if this is a repeat question:
I have extended my H1B (approval received) but my visa stamp expires in June 06. I have EAD (not using it) and plan to apply for AP. If I travel outside the country (with AP, of course), do I need to get a new HIB visa stamp to reenter? Can I show my AP, and 485 pending papers to come in as a parolee and still retain my H1B? Or my H1B status will get cancelled if I use AP?
I hear conflicting opinions from different people and I don't when I would be need to travel to India for family reasons. If anybody has been in a similar situation, please let me know your experience.

under OPT you are still on F1 Visa...If you join another degree, you can still have F1, I believe you just need to inform the university on which your visa was issued about the university transfer. International affairs at your new univ. should help in this regard.

Hi All,
I got H1 B visa recently which has been processed by my consultant. Right now I am working in india. My current employer is asking me to go for an assignment to US with L1 Visa. My question is :
1) Do i get any problem for my current H1 visa, If I attend again to Embassy for L1.
Some of my friends are telling me that my current H1B visa will be cancelled in order to get L1 .. Please any one clarify my doubt...

I am trying to change my job from PM to technical lead. My labor was filed for computer systems manager. Will technical lead come under the same category & occupation as computer systems manager?. New employer agreed to give me similar job duties in EVL & I am getting 40% hike. Is it wise to use AC-21 here?.

Hi All,
I just called USCIS using the POJ method to check on my I485 status which is current for June (EB2 India PD is 3/20/04).
IO said a visa needs to be ordered for the file and it will be done in the next quarter i.e, July 08.She also said the file will not be assigned to the IO unless the visa is ordered??
Does this mean that all the visas for EB2 have been used for this quarter? Also, not sure why the file wont be worked on until the visa is ordered...which contradicts the pre-adjudication theory.

On I140 form, notice type has information about INS section.
The INS section explain that your GC is under EB2 category or EB3 category.

INA Section 203(b) (2) is EB-2

depends on state law, WA state does not consider H4 as a resident, just found out a month ago, when my wife finished all the tests and everything else and found she had to pay non resident tuition. So she decided not to go to school. CA considers H4 as a resident provided all other criteria are met.

Do we (parent) gets any benefits in terms of Visa status if you have child born in USA and you stay in US for certain years?
In the other word:
Once you have child born in USA is there any way to get green card based on your child citizenship?
Once the US citizen child is an adult (I think 21 years old), then s/he can sponsor the parents for green card.
Otherwise, no.

This is the scenario:
1. Husband becomes a LPR this year.
2. Wife still undocumented.
3. Wife was working long time ago, but became a housewife for the past 6 years, so no work.
How would the wife adjust her status under the new CIR if she was not working for the past 6 years?
Would she have to wait until the husband is able to petition her through other regular means?
Any ideas or is it too early to tell how USCIS will issue it's regulations about CIR?

Good morning and thank you for reading my message and considering my question
My attorney has filed an appeal with DOL regarding my prevailing wage, which my state workforce commission rejected (deeming it too low). We were told that we should expect a response from DOL in about 3 weeks, but it has now been close to 10 weeks and we have received no response yet. The attorney is checking with DOL weekly but there has been no response thus far. Is this normal? How long can I expect to wait for a response? Thank you very much in advance for any guidance!

This is my third EAD renewal. My 485 is pending at NSC. I am in CA. All my previous EADs/APs etc were filed at NSC.
This time when my EAD renewal is filed (by my new attorney, in new company) I got receipt Number starting with MSC.
Who decides where to file MSC? What's the criteria to file at MSC? Shouldn't it be file at NSC?
Is this a mistake?
No it is not. It is the National Benefits Center receipt number. Mine got transferred from the TSC.

Illegal non-immigrants did the rally to local USCIS offices. It would be good if we pick one day in 2nd week of July and have a rally to local USCIS offices. This will immediately catch the media attention.
