Guys,
I am at present on non-cap h1b and i have asked an employer to file for a new caped h1b in april 2008.
I have tentative plans of going to india in March end . In case i can't make it before april 1st back to US, can my new emplyer file for my New h1b while i am out side US...???
Is there any rule that, lates i-94 needs to be sent while aplying for h1b..???

As suggested by pappu/starsun, this supporting thread provides impacted members with additional information and tools to help the initiative.

As pappu stated in the first post of the above referenced thread - some of the ongoing efforts include finding how many IV members would get benefit from such a provision and get basic details such as username/Priority Date of impacted members. Future action items might include drafting documents and letters to support this provision. There maybe actions such as sending emails etc. However we would not be able to open a public action item unless we can have thousands of our members willing to participate in a grassroots action item. This survey intends to understand the needs of our membership for this provision and collect grassroots information.
The fact is we have a dedicated group of volunteers (and we need more) who have been trying their best to spread the message about this initiative so that a strong grass-roots support can be created leading up to launch of the public action items. So far we have around 1100 people who have responded. Based on quick calculations carried out using PERM data, it is estimated that there are at least 60K-70K EB applicants waiting to file I-485/EAD/AP (this is a very conservative estimate..the actual number could be much more). Grass-roots initiatives require time and patience and we request maximum number of impacted folks to participate actively.

Hello,
Recently I applied for AP. It was approved on Oct 20, 2009 but when I got the document from USCIS I found that the effective date of my AP is from 12/20/2009 to 12/19/2010. My question is,
1. I want to go to India on 26th Nov and return on 20th December. Some of my friend told me that I can travel between 12/20/2009 to 12/19/2010 not not before 12/20/2009. Is it correct.
2. My understanding was I can go to India before effective date which is 12/20/2009 and can return on or after 12/20/2009. Is this correct.
Please respond as I want to go to India on Nov 26th 2009 due to some emergency.

I think I know the answer to this, but I just wanted to make sure from the experts on this forum.
Do we need to apply for new EAD/AP if we change jobs using AC21 even if the current EAD/AP (approved when working for the GC sponsoring employer) are valid for almost 10 more months?
I think that EAD/AP are not dependent/tied to the employer.
Am I right gurus?

My I-140 & I-485 applications had been transferred to VSC for receipting and later my I-485 was transferred back to TSC. But my I-40 has been pending at VSC for close to 6 months with no signs of any processing. VSC seems to be still processing Apr 06 applications while TSC has been processing I-140 under 6 months. Realistically my application should have stayed at TSC, but was transferred to VSC due to receipting delays and balance the workload. But now my application is stuck at VSC. For no fault of mine, my applications ended up in VSC. There is no signs of PP starting anytime soon. Can I lodge a complain to ombudsman in this regard? Will they be able to help me? Who do I contact and where can I find all the information to lodge a complaint?
