I am currently starting a language institute in California. I incorporated the organization 2 years ago, but I am starting it now. I want to hire a Brazilian national on an h2b visa to teach Portuguese but I am worried that as I am starting the business now and haven't generated income yet I won't be allowed to hire this teacher. Is this something I should worry about? Thank you for any help. I appreciate it.

This is a standard response message which comes after USCIS receives the response to RFE and resumes case processing.
There is no way to determine when the case would be adjudicated and what will be the result. It could happen next week or take months.

While we all sit and wait in this painful 485 retrogression, I am just wondering, what if the retrogression pulls on past the 3 year extension (attained after the initial 6 years and I140 approval).
I have my perm LC/I140 approved/485 retrogressed with a PD of Feb 2006.
Being EB2 and starting my 7/8/9 years in early 2007, I am a bit unlikely to hit that scenerio, but someone like me in EB3 is very likely to hit that scenerio...
Does anyone know, what happens after 9 years on H1 and not able to file 485 due to retrogression??

OED defines Visa as "An endorsement on a passport indicating that the holder is allowed to enter, leave or stay for a specified period of time in a country"
By that definition I believe that a visa can be issue anywhere, inside and outside of the country.

My AP is expering next month(NOV), I don't have any travel plans for next 1 year. i'm planing to apply in 2010 not now.
do i need to apply for extesion for evey year, if don't need also?

There is no AP renewal. You can apply AP later if you are not planning to travel. But AP is for travel during emergencies. It takes time to get the AP approval. Hence people keep it current all the time.

If the hospital (healthcare organization) is a non-profit body then they will not be subjected to the quota (I think). Maybe other members can validate this.

The Memphis Commercial Appeal reports on today's citizenship swearing in of Irish-born James Patrick O'Donnell. Spouse I-485 Receipt Notice.
Applied I-485 for my wife in the first week of September (8th Sept) when the dates became current, but haven't received the receipt
number yet.
I got an RFE (EVL) on my application which I submitted on 21 Sept. USCIS received the response on 22nd Sept and updated the case.
I am little worried that whether USCIS has received her application or not. Is there a way to find out, whether I can open an Service request or take an Info Pass regarding this?
Any suggestions will be helpful.

They applied for my labor in December of 2007 and it was audited and finally I was told in June 2010 that it was denied. Actually it was denied in January 2010 but they did not reveal this information intentionally. Now I am in my 6th year of my H1b which expires in March 2011. Can someone help me out how to sue the company for not revealing the information and firstly how can I stay in the country. BTW I have done Masters here and I am with another company now. Appreciate all your suggestions.
