What is the impact on GC (485 application) approval for a minor Customs violation at the airport?.
I unintentionally ignored to declare some food that i was bringing and airport customs officer fined me $300.
Will this impact my 485 application, that i will be filing soon?.
Ofcourse, i am going to mention in part 3 b.of application and provide the fine receipt.
Will my GC be denied because of this?.
Please advice.

Per old instructions everyone was sending to Nebraska, and new instructions published are for 'direct filing'.
Do I follow direct filing rule or Nebraska only rule?

Rescheduling your FP can delay your background check etc., and can complicate your GC approval timeframe. Its better not to reschedule and stick to the appointment unless their is an emergency.
AFAIK, their is no limit on the number of times you can reschedule though, but its advisable not to reschedule for the reasons mentioned earlier..

Guys,
I am generally a lurker in this website. Based on the other threads, I came to the reality there is no way I am getting my GC for another 4-5 years or may be even longer.
However, the USCIS site has a status "Card/Document production". The last status update date was 6/25/2010. The only update I could think of is my new address around the same time. I went to the USCIS status website after 2 years out of curious, after I got back from giving my finger prints (3rd since I485 filing) today.
Is the USCIS jerking me off? :rolleyes:

This survey intends to understand the needs of our membership for this provision and collect grassroots information.
The fact is we have a dedicated group of volunteers (and we need more) who have been trying their best to spread the message about this initiative so that a strong grass-roots support can be created leading up to launch of the public action items. So far we have around 1100 people who have responded. Based on quick calculations carried out using PERM data, it is estimated that there are at least 60K-70K EB applicants waiting to file I-485/EAD/AP (this is a very conservative estimate..the actual number could be much more). I was on H1 visa and laid off from job on 10/30/09. I got severance pay for Nov. and have the pay stubs. I applied for COS from H4 to F1 for my spouse (already in collage) and H1 to F2 for me on 12/9/09. Meanwhile immigration performed spot check at my ex-employers on 12/3/09, so they came to know that i was not working. My employer had not revoked H1 by then. Our COS application was received by USCIS on 12/14/2009, case is currently under Initial Review.
- Will the immigration officers who did spot check inform USCIS that i was out of status?
- Will case get rejected due to delay in applying for COS?
- Will there be any complications in transferring my H1 to new employer as i was out of status for about a month before i applied for COS?
- How to stop F2 COS if i get H1 transfer approved first?

Anybody filed Un Signed Labor Substitution?
Since the cut off date was Jul 17th my attorney filed un signed Labor substitution with I-140.
Any experince any body has, I request you to share that here.

I see lot of excitement about asking USCIS about filing for I-485
even when visa numbers are unavailable. I am afraid this may
not work.
The ombudsman report 2005 was very critical about temporary EADs being issued to "potential terrorists" without proper background check. Filing for I-485 and getting EAD is like a limbo state btween GC and H1B. This approach may not gain much support.
(1) How about proposing that they should do FBI name check with I-140?
This is the petition for immigrant visa.
(2) Those who have approved I-140 but haven't filed for I485 due to
retrogression can apply for FBI name check separately.
(3) These added "security measures" will boost our chances of getting them OK to file for I-485 even when PD is not current.
p.s
the argument that FBI name check is valid only for a breif period is stupid, but it may be forthcoming. The response is what if some one commits terrorism 6 months after getting GC:D

We are getting ready to file for another H1B extension, and based on work location, will have to file with the Vermont Service Center. The employer is NOT cap-exempt, but I have had an H1B for many years (so do not need to file for new visa). I am not sure which is the correct address for filing, though. (See p. 20, I-129 instructions.) I think we need to use:
All other I-129 Cases:
USCIS
Vermont Service Center
ATTN: I-129
75 Lower Welden Street
St. Albans, VT 05479-0001.
(Other option:
H-1B Cap Cases:
USCIS
Vermont Service center
ATTN: H-1B Cap
1A Lemnah Drive

Can you confirm the first address (for all other cases) is correct?

Well that is what I had done. It should not be a problem. Always keep photocopies of the whole passport just in case.
